Cheesecherry is a brand label owned and operated by 999Tee (India) Private Limited.

These Terms of Service (“Terms”) govern your access to and use of our website, www.cheesecherry.com, including the purchase and use of products and services offered through the website.

By accessing, browsing, or using our website, you agree to comply with these Terms to the extent applicable to your activities. By placing an order, you agree to the Terms and policies applicable to your purchase.

If you do not agree with these Terms, please discontinue use of the website.

1. Definitions

For the purposes of these Terms:

“Cheesecherry”, “we”, “us”, or “our” refers to 999Tee (India) Private Limited, operating the Cheesecherry brand label.

“You”, “your”, “customer”, or “user” refers to any person who visits, browses, accesses, or purchases from our Website.

“Website” refers to www.cheesecherry.com and its associated online services.

“Products” refers to clothing, accessories, gift cards, and other items offered for sale through the Website.

“Store Credit” refers to a non-cash credit balance issued to an eligible customer's Cheesecherry account in accordance with our Return, Refund & Exchange Policy.

“Gift Card” refers to a prepaid digital gift card purchased through the Website, subject to its applicable terms.

“Business Day” refers to Monday through Saturday, excluding public holidays and other officially observed non-working days applicable to our operations.

2. Eligibility to Use

By using this Website or placing an order, you confirm that you are legally capable of entering into a contract under applicable law.

You must be at least 18 years of age to independently place an order through our Website.

If you are under 18, you may use the Website only under the supervision of a parent or legal guardian, who must undertake any purchase on your behalf.

Product availability, specifications, descriptions, and prices may change from time to time.

We reserve the right to correct genuine errors, inaccuracies, or omissions in product information, pricing, availability, or promotional details.

Where a material error affects an existing order, we will communicate the issue and provide an appropriate resolution, including cancellation and refund where applicable.

Nothing in this section limits customers' rights concerning defective, deficient, incorrect, or materially misdescribed products.

5. Pricing, Taxes & Payments

Unless otherwise stated, prices displayed on the Website are expressed in Indian Rupees (INR).

Applicable taxes, shipping charges, and other mandatory costs will be disclosed before the customer completes payment.

The final payable amount will be displayed during checkout.

Cheesecherry currently accepts prepaid orders only.

Depending on availability, accepted payment methods may include:

• Credit cards.
• Debit cards.
• UPI.
• Net banking.
• Digital wallets.
• Other prepaid payment methods displayed at checkout.
• Eligible Cheesecherry Store Credit or Gift Cards.

All electronic payments are processed through authorised third-party payment service providers.

By completing a transaction, you confirm that you are authorised to use the selected payment method.

Cheesecherry does not store complete card numbers, CVVs, UPI PINs, net banking passwords, or other sensitive payment credentials.

We may cancel or temporarily hold an order where payment fails, remains unconfirmed, is reversed, or requires reasonable verification.

6. Cash on Delivery

Cash on Delivery (COD) and Partial Cash on Delivery are not currently available on Cheesecherry.

All orders must be prepaid using an accepted payment method displayed at checkout.

If COD or Partial COD becomes available in the future, applicable eligibility requirements, payment conditions, charges, and restrictions will be communicated before purchase.

Until such options are officially introduced, no COD-specific conditions apply to purchases through the Website.

7. Orders & Order Acceptance

Placing an order constitutes an offer to purchase the selected products.

An automated order acknowledgement confirms receipt of the order details but does not prevent us from addressing genuine payment, pricing, inventory, or fulfilment errors.

Orders are processed following successful payment confirmation and acceptance.

We reserve the right to refuse, limit, verify, or cancel orders for legitimate reasons, including:

• Product unavailability.
• Genuine pricing or product-information errors.
• Payment failure or verification issues.
• Suspected fraudulent activity.
• Misuse of promotional offers or store credit.

If Cheesecherry cancels an order because it cannot be fulfilled, the customer will receive a full refund to the original payment method.

Such refunds will be initiated within 2 business days of cancellation confirmation.

Store credit may be offered instead only where the customer voluntarily agrees.

Customers may request order modifications or cancellations before packing or fulfilment begins.

Once fulfilment has started, modifications or cancellations may no longer be possible.

8. Promotions, Offers & Discount Codes

Cheesecherry may offer promotional campaigns, discount codes, limited-time offers, clearance sales, bundles, or other special promotions.

Such offers may be subject to specific conditions, including:

• Promotional validity periods.
• Product eligibility.
• Minimum purchase requirements.
• Maximum discount values.
• Usage restrictions.
• Customer eligibility.
• Stock availability.
• Final-sale conditions.

We may modify, suspend, withdraw, or discontinue promotional offers, subject to applicable law and any commitments already made to customers.

Use of a regular discount code, including a standard welcome offer, does not automatically remove a product's eligibility for standard returns or exchanges.

Products purchased under designated sale, clearance, special bundle, multi-buy, or expressly identified final-sale offers may be ineligible for discretionary returns or exchanges, as stated in our Return, Refund & Exchange Policy.

Such restrictions must be disclosed before purchase and do not affect applicable consumer rights.

Cheesecherry may investigate suspected promotional misuse and take reasonable action where appropriate.

9. Shipping & Delivery

Shipping, dispatch, delivery estimates, tracking, delivery attempts, international shipping, customs duties, return-to-origin shipments, and related conditions are governed by our Shipping & Payment Policy, which forms part of these Terms.

Customers are responsible for providing accurate delivery details and ensuring reasonable availability to receive their orders.

Delivery timelines may vary depending on location, logistics operations, weather, serviceability, or other circumstances.

Any estimated timeline will be interpreted consistently with applicable consumer-protection requirements.

If a shipment is returned due to customer-related delivery failures, reasonable and previously disclosed logistics charges may apply, as detailed in our Shipping & Payment Policy.

Where delivery fails due to circumstances attributable to Cheesecherry or its delivery partners, customers will not be unfairly penalised.

In the event of an inconsistency concerning shipping, payment, or delivery arrangements, the relevant specific policy will apply, subject to applicable law.

10. Returns, Refunds, Exchanges & Store Credit

All returns, refunds, size exchanges, store-credit issuance, return eligibility, reverse pickup charges, quality inspections, rejected returns, and related conditions are governed by our Return, Refund & Exchange Policy, which forms part of these Terms.

Standard Returns

Customers may request eligible standard returns within 7 days (168 hours) of delivery.

Approved standard returns are issued as Cheesecherry Store Credit, rather than refunds to the original payment method.

Store credit is issued following successful quality inspection and is generally valid for 12 months from issuance.

Applicable reverse pickup charges and other return conditions are explained in the Return, Refund & Exchange Policy.

Size Exchanges

Eligible products may qualify for one direct size exchange, subject to stock availability and the applicable exchange conditions.

Store Credit

Store credit:

• Is linked to the original customer's account.
• May be used across multiple purchases.
• May be combined with other available store-credit balances.
• May be used on eligible sale and regular-priced merchandise.
• Cannot be transferred or exchanged for cash.
• Cannot be used to purchase digital gift cards.
• Is subject to applicable expiry conditions.

The detailed rules concerning store-credit balances, redemption priority, expiry dates, cancellations, repeat returns, and exceptional grace periods are contained in our Return, Refund & Exchange Policy.

Exceptions & Qualifying Refunds

Refunds to the original payment method remain available in circumstances including approved pre-fulfilment cancellations, orders cancelled by Cheesecherry, and qualifying defective, incorrect, or materially misdescribed products.

Any legally required remedy takes precedence over discretionary store-credit conditions.

In the event of an inconsistency concerning returns, refunds, exchanges, or store credit, that specific policy will apply, subject to applicable law.

11. Intellectual Property

All content available on the Website, including but not limited to:

Orders placed before this date remain subject to the contractual purchase, return, refund, and exchange conditions applicable when those orders were placed.

Continued use of the Website after a revision may constitute acceptance of the updated Website-use conditions, subject to applicable law and any consent requirements.
